When Moral Talk Becomes Profitable.Mario I. Juarez-Garcia - forthcoming - Ethical Theory and Moral Practice:1-19.
Should businesses engage in moral talk when it becomes profitable? Due to their particular position of visibility, it is reasonable to acknowledge that businesses have specific moral duties. Some might argue that companies ought to help abandon morally repugnant norms by providing examples of alternative behaviors through advertisements. However, the moral talk of businesses might unexpectedly reinforce repugnant norms and increase social tensions in a polarized society. Then, the duty of the companies is not fulfilled when they engage in moral (...)

    Official Disobedience: Bureaucrats & Unjust Laws.Mario I. Juarez-Garcia - forthcoming - Criminal Law and Philosophy:1-21.
A legitimate expectation in a liberal democracy is that public officials enforce the law regardless of its content; when they don’t do so, their actions tend to be publicly condemned. This expectation puts street-level bureaucrats in a moral dilemma when they consider that a certain law is unjust: either they don’t enforce the law and violate their duties to the citizenry, or they enforce it and become complicit in injustices. This paper argues for the legal permission of public officials to (...)

    Should We Resurrect Institutional Corruption?Mario I. Juarez-Garcia - 2023 - Public Affairs Quarterly 37 (1):1-19.
Worried that the current paradigm of political corruption (individual corruption: the misuse of public office for private gain) is too narrow to protect democratic institutions from private interests, the political theorist Dennis Thompson resurrects the premodern notion of institutional corruption, which refers to practices that undermine the purpose of political institutions. From the lenses of institutional corruption, practices such as money in political campaigns, lobbying, or wealth inequality are to be condemned and eradicated to protect democratic institutions. The goal of (...)

    Public Servants.Mario I. Juarez-Garcia & Alexander Schaefer - 2022 - Journal of Moral Philosophy 20 (1-2):79-110.
Several political philosophers have recently pointed out that current electoral democracies fail to facilitate accurate and reliable feedback on the performance of public officials. Rather than rejecting democracy as a hopeless ideal, we defend an institutional reform called Service Responsibility, which introduces a superior incentive structure that better aligns the interests of citizens and public officials. Service Responsibility requires increasing or decreasing the income of public officials insofar as they succeed or fail to achieve democratically chosen goals. Later, we consider (...)

    The Moral Incompetence of Anti-corruption Experts.Mario I. Juarez-Garcia - 2021 - Res Publica 27 (4):537-557.
This paper studies the lessons of principled anti-corruption experts who dared to fulfill their duty of justice in highly corrupt societies, through the true story of Ngozi Okonjo-Iweala, the former Finance Minister of Nigeria. My thesis is that when principled anti-corruption experts are epistemic trespassers, they show moral incompetence. Okonjo-Iweala shows moral incompetence in two ways: she misread the opposition to her strategies and misled other honest reformers. Both actions bungled her efforts to eradicate corruption inasmuch as they hindered the (...)

    Exit & isolation: Rousseau’s state of nature.Mario I. Juarez-Garcia & Alexander Schaefer - 2022 - Synthese 200 (3):1-21.
Game theory has proven useful in clarifying Hobbes’s argument that the state of nature will inevitably devolve into a state of war. Mathematically-leaning philosophers, however, have paid little attention to Rousseau’s depiction of the state of nature as a peaceful, asocial state of solitary wanderers. This paper articulates Rousseau’s critique of Hobbes in formal terms, which pinpoints two crucial issues in Hobbes’s account: the lack of an exit option and an unrealistic depiction of human nature. Building upon recent game-theoretic treatments (...)

The attachment to the ancestral worship among Africans combines the respect for the dead who are now near the Great One, and the power they have after death over earthly problems. They have control over a lot of earthly elements, and at the same time they are now able to fight the evil spirits which send evil spells on the living. I have heard of a Lenje prayer to the ancestors, which runs as follows: 'You our ancestors who were so (...)

The four domains of spiritual well-being, personal, communal, environmental and transcendental (Fisher, Spiritual health: its nature and place in the school curriculum, PhD thesis, University of Melbourne, 1998; Gomez and Fisher, Pers Individ Differ 35:1975–1991, 2003) are examined in relation to idealism and relativism (Forsyth, J Pers Soc Psychol 39(1): 175–184, 1980). Epistemologists have debated at length whether scientific discovery is a rational and logical process. If it is, according to the Artificial Intelligence hypothesis, it should be possible to write computer programs able to discover laws or theories; and if such programs were written, this would definitely prove the existence of a logic of discovery. Attempts in this direction, however, have been unsuccessful: the programs written by Simon's group, indeed, infer famous laws of physics and chemistry; but having found no new (...)

  20. Novel Predictions and the No Miracle Argument.Mario Alai - 2014 - Erkenntnis 79 (2):297-326.
Predictivists use the no miracle argument to argue that “novel” predictions are decisive evidence for theories, while mere accommodation of “old” data cannot confirm to a significant degree. But deductivists claim that since confirmation is a logical theory-data relationship, predicted data cannot confirm more than merely deduced data, and cite historical cases in which known data confirmed theories quite strongly. On the other hand, the advantage of prediction over accommodation is needed by scientific realists to resist Laudan’s criticisms of the (...)

Philosophers now seem to agree that frequentism is an untenable strategy to explain the meaning of probabilities. Nevertheless, I want to revive frequentism, and I will do so by grounding probabilities on typicality in the same way as the thermodynamic arrow of time can be grounded on typicality within statistical mechanics. This account, which I will call typicality frequentism, will evade the major criticisms raised against previous forms of frequentism. In this theory, probabilities arise within a physical theory from statistical (...)

  24. Is the Statistical Interpretation of Quantum Mechanics ψ-Ontic or ψ-Epistemic?Mario Hubert - 2023 - Foundations of Physics 53 (16):1-23.
The ontological models framework distinguishes ψ-ontic from ψ-epistemic wave- functions. It is, in general, quite straightforward to categorize the wave-function of a certain quantum theory. Nevertheless, there has been a debate about the ontological status of the wave-function in the statistical interpretation of quantum mechanics: is it ψ-epistemic and incomplete or ψ-ontic and complete? I will argue that the wave- function in this interpretation is best regarded as ψ-ontic and incomplete.

This study examines the relationships of empathy, moral identity and cynicism with the following dimensions of consumer ethics: the passive dimension (passively benefiting at the expense of the seller), the active/legal dimension (benefiting from questionable but legal actions), the ‘no harm, no foul’ dimension (actions that do not harm anyone directly but are considered unethical by some) and the ‘doing-good’/recycling dimension (pro-social actions). A survey of six hundred Australian consumers revealed that both empathy and moral identity were related to negative (...)

    Heraclean Overhaul(s): Par-a-noia_, Badiou’s Un-thought, and Neurodiversity in _H of H.Mario Telò - 2023 - Classical Antiquity 42 (2):280-292.
This paper considers Carson’s rewriting of Heracles’ tragic madness— through the art of collage, an assembling and disassambling of textual fragments, scraps of papers, drawings, chromatic smears, and sketches—as an imagistic site for theorizing the anti-normative materiality, physical and metaphysical, of par-a-noia. I make a case for a materiality of par-a-noia by proposing a comparison with Alain Badiou’s Marxist political formalism. The distinctive formal trait of H of H, verbal and pictorial juxtaposition, invites us to think of par-a-noia as an (...)

A survey was conducted to investigate the relationship of Australian consumers’ lived (experienced) spiritual well-being and materialism with the various dimensions of consumer ethics. Spiritual well-being is composed of four domains—personal, communal, transcendental and environmental well-being. All four domains were examined in relation to the various dimensions of consumers’ ethical beliefs (active/illegal dimension, passive dimension, active/legal dimension, ‘no harm, no foul’ dimension and ‘doing good’/recycling dimension). The results indicated that lived communal well-being was negatively related to perceptions of the active/illegal (...)

We argue that the asymmetry between diverging and converging electromagnetic waves is just one of many asymmetries in observed phenomena that can be explained by a past hypothesis and statistical postulate (together assigning probabilities to different states of matter and field in the early universe). The arrow of electromagnetic radiation is thus absorbed into a broader account of temporal asymmetries in nature. We give an accessible introduction to the problem of explaining the arrow of radiation and compare our preferred strategy (...)

Analyzing the Dialogue between a Philosopher and a Student of the Common Laws of England by Thomas Hobbes, the essay traces the historical tradition and the reasons for its secular underestimation. The Hobbesian text is placed within the history of English law and the controversies that accompanied and followed the revolution of 1640. It is then compared with the political works of Hobbes, showing how the silence of the law is gradually replacing the state of nature as image of the (...)

I analyze how the carnal dimension of sovereignty, migrates into a new body, the body of the people, and in various traces appears in the filmic mode of production that marked the twentieth century. I analyse or instead bring into imaginary connection two characters who in a way embody this migration: Judge Daniel Paul Schreber, occupied (...)

The causal problem has become topical once again. While we are no longer causalists or believers in the universal truth of the causal principle we continue to think of causes and effects, as well as of causal and noncausal relations among them. Instead of becoming indeterminists we have enlarged determinism to include noncausal categories. And we are still in the process of characterizing our basic concepts and principles concerning causes and effects with the help of exact tools. This is because (...)

I want to combine two hitherto largely independent research projects, scientific understanding and mechanistic explanations. Understanding is not only achieved by answering why-questions, that is, by providing scientific explanations, but also by answering what-questions, that is, by providing what I call scientific descriptions. Based on this distinction, I develop three forms of understanding: understanding-what, understanding-why, and understanding-how. I argue that understanding-how is a particularly deep form of understanding, because it is based on mechanistic explanations, which answer why something happens in (...)

In this paper, we answer this question by arguing for five necessary conditions for ideal understanding: (i) representational accuracy, (ii) intelligibility, (iii) truth, (iv) reasonable endorsement, and (v) fitting. Even if one disagrees that there is some form of ideal understanding, these five conditions can be regarded as sufficient conditions for a particularly deep level of understanding. We then argue that grasping, novel predictions, and transparency (...)
